Mental Health

Mental Health Law is a growing, demanding and complex area of law. At East Anglian Chambers, we aim to provide the level of expertise in this difficult field, but also to supply the knowledge with empathy and consideration for the patient, family and friends.
At East Anglian Chambers, we specialise in a range of mental health issues. These include compulsory detention and the adequacy and appropriateness of documentation.

We can also advise on the powers of the Mental Health Review Tribunal (part of the First-tier Tribunal's Health, Education and Social Care Chamber), the conduct of managers’ hearings and policies on the restraint of patients, searches and discharge.

Our team act in the following areas:
  • The interpretation of the Mental Health Act 1983
  • The lawfulness of detention and consent to treatment
  • Advice and representation in respect of the Mental Health Review Tribunal
  • False imprisonment claims
  • Judicial review
For issues arising under the Mental Capacity Act 2005 please see the "Court of Protection" page under the heading "Family Law".

Please call East Anglian Chambers on 01473 214481 and speak to one of our clerking team for further advice and assistance on Mental health.
