Alternative Dispute Resolution

In a recent speech delivered in India (Alternative Dispute Resolution: An English Viewpoint — India, 29th March 2008) Lord Phillips of Worth Matravers, Lord Chief Justice of England and Wales, discussed recent judicial pronouncements on the subject, both official and unofficial, and concluded:

"Let me end by nailing my colours firmly to the mast. I number myself with Sir Anthony Colman and Sir Gavin Lightman as an enthusiastic supporter of ADR.

"It is madness to incur the considerable expense of litigation – in England usually disproportionate to the amount at stake – without making a determined attempt to reach an amicable settlement.  The idea that there is only one just result of every dispute, which only the court can deliver is, I believe, often illusory.  Litigation has a cost, not only for the litigants but for society, because judicial resources are limited and their cost is usually borne – at least in part – by the state.  Parties should be given strong encouragement to attempt mediation before resorting to litigation.  And if they commence litigation, there should be built into the process a stage at which the court can require them to attempt mediation – perhaps with the assistance of a mediator supplied by the court."

As panel members of adroit Dispute Resolution Limited, which operates from our Norwich address, four members of chambers offer their services as general (not family) mediators. Their details, together with those of other independent mediators practising in the region, may also be found on the web site of, and in the brochures produced by, the regional umbrella group, Mediators in East Anglia, details of which should be available on display in your local County Court Office. If they are not please ask the court staff for details.

As a chambers we can also provide skilled and experienced practitioners, some members of the Chartered Institute of Arbitrators or holders of a part-time judicial post, who would be suitable to conduct private arbitrations.

If you are interested in this service please consult Steve Collis at Norwich.
